DMCA Policy
How to tell us about material you own the rights to, and what we do when you send that notice.
Digital Millennium Copyright Act Notice
We take copyright complaints seriously and expect subscribers to do the same. Under the Digital Millennium Copyright Act of 1998, we act on properly made infringement claims without delay. Note that we do not host or transmit programming ourselves, which shapes what we are able to do in response. We will respond promptly to claims of copyright infringement committed using our Smart IPTV service.
Filing a DMCA Takedown Notice
If you own a work you believe is being infringed via this service, write to our designated agent. The DMCA requires a valid notice to contain all six of the following, so a notice missing any of them cannot be acted on:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and where it is located on the Smart IPTV service
- Your contact information, including your address, telephone number, and email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law
- A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
How to Submit Your DMCA Notice
Send notices to:
Email: help@smartiptvs.tv
Put "DMCA Takedown Request" in the subject line. It routes the message straight to the person who handles them rather than into general support.
Counter-Notification
If we removed something of yours in error, you can file a counter-notification. As with a takedown notice, the statute sets out what it has to contain:
- Your physical or electronic signature
- Identification of the material that was removed and the location at which it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district
Repeat Infringers
Accounts belonging to repeat infringers are suspended and, where warranted, closed for good.
